ISLAMABAD: Senate Chairman Mian Raza Rabbani on Thursday said that print media attributed an observation made during the proceedings of the Supreme Court in a suo moto case regarding illegal transplantation of kidney, wherein, it was observed that, “They cannot force the Parliament to make legislation but can point out flows in any law.”
The Parliament enacted a law back in 2010, after extensive consultation with all stakeholders, for The Transplantation of Human Organs & Tissues Act, 2010. The said law was passed by the National Assembly on November 12, 2009, by the Senate on February 10, 2010 and received the president’s assent on March 18, 2010.
Through the said law, a mechanism was provided to check illegal transplantation of human organs and penal provisions were provided for commercial dealings in human organs. The law also delegated rule making power to the executive.
Recently, an amending Bill titled The Transplantation of Human Organs & Tissues (Amendment) Bill, 2017 was passed by the National Assembly and forwarded to the Senate which will be taken up in the next session of Senate commencing from March 5, 2018.
The above factual position reflects that the Parliament is cognisant of the issues being faced by the public at large and performs its legislative role to provide laws to the executive for implementation; furthermore, laws remain under review of the Parliament and are accordingly amended in order to address the existing/evolving realities.
It is true that the Parliament cannot be forced to legislate but it is also correct that the Parliament is performing its role of legislation and effective oversight.
